Editorial and Opinions Education: State and National Shield Laws in the USA

First, we want to define for you what an Editorial piece means:

An editorial, leading article (UK) or leader (UK), is an opinion piece written by the senior editorial staff or publisher of a newspaper, magazine, or any other written document. Editorials may be supposed to reflect the opinion of the periodical.[citation needed] In Australian and major United States newspapers, such as The New York Times[1] and The Boston Globe,[2] editorials are often classified under the heading “opinion”.

Illustrated editorials may appear in the form of editorial cartoons.[3]

Typically, a newspaper’s editorial board evaluates which issues are important for their readership to know the newspaper’s opinion.[4]

Editorials are typically published on a dedicated page, called the editorial page, which often features letters to the editor from members of the public; the page opposite this page is called the op-ed page and frequently contains opinion pieces by writers not directly affiliated with the publication. However, a newspaper may choose to publish an editorial on the front page. In the English language press, this is done rarely and only on topics considered especially important; however, it is more common in some European countries such as Spain, Italy, and France.[5]

In the field of fashion publishing, the term has been adapted to refer to photo-editorials – features with often full-page photographs on a particular theme, designer, model or other single topic, with or (as a photo-essay) without accompanying text.[6]

Second, we want to define for you what an Opinion piece means:

In general, an opinion is a judgment, viewpoint, or statement about matters commonly considered to be subjective.

What distinguishes fact from opinion is that facts are verifiable, i.e. can be objectively proven to have occurred. An example is: “United States of America was involved in the Vietnam War” versus “United States of America was right to get involved in the Vietnam War”. An opinion may be supported by facts, in which case it becomes an argument, although people may draw opposing opinions from the same set of facts. Opinions rarely change without new arguments being presented. It can be reasoned that one opinion is better supported by the facts than another by analyzing the supporting arguments.[1] In casual use, the term opinion may be the result of a person’s perspective, understanding, particular feelings, beliefs, and desires. It may refer to unsubstantiated information, in contrast to knowledge and fact.

Collective or professional opinions are defined as meeting a higher standard to substantiate the opinion.

Editorial opinion[edit]

An “editorial opinion” is the stated opinion of a newspaper or of its publisher, as conveyed on the editorial page.

And Fourth California Shield Law:

In California, article I, section 2(b) of the California Constitution and Evidence Code section 1070 provide an immunity from being held in contempt to reporters, editors, publishers, and other people connected with or employed by newspapers, magazines, press associations and wire services, as well as radio or TV news reporters.

The California shield law applies to both the source of information (“confidential sources”) and to “unpublished information” such as notes, out-takes, unpublished photographs and tapes.

When a criminal defendant seeks information protected by the shield law, the courts have set up a “balancing test” which weighs how important the information is to the criminal defendant, whether the defendant can get the information elsewhere, and other factors.  See Delaney v. Superior Court (1990) 50 Cal. 3d 785.

On the other hand, when the prosecution seeks information in a criminal law, the shield law is absolute.  Miller v. Superior Court (1999) 21 Cal. 4th 883.  And in a civil case where the press is not a party, the immunity from contempt is also absolute – there’s no balancing test.  New York Times v. Superior Court (1990) 51 Cal. 3d 453.   This case helps journalists avoid being forced to be professional witnesses instead of professional journalists.

Does the shield law cover bloggers?  Good question.  The California shield law covers people “connected with or employed upon” a “newspaper, magazine, or other periodical publication, or by a press association or wire service.”   That question is likely to be litigated in the near future.

Additional information on the California Shield Law, Evidence Code Section 1070

1070. (a) A publisher, editor, reporter, or other person connected with or employed upon a newspaper, magazine, or other periodical publication, or by a press association or wire service, or any person who has been so connected or employed, cannot be adjudged in contempt by a judicial, legislative, administrative body, or any other body having the power to issue subpoenas, for refusing to disclose, in any proceeding as defined in Section 901, the source of any information procured while so connected or employed for publication in a newspaper, magazine or other periodical publication, or for refusing to disclose any unpublished information obtained or prepared in gathering, receiving or processing of information for communication to the public.

(b) Nor can a radio or television news reporter or other person connected with or employed by a radio or television station, or any person who has been so connected or employed, be so adjudged in contempt for refusing to disclose the source of any information procured while so connected or employed for news or news commentary purposes on radio or television, or for refusing to disclose any unpublished information obtained or prepared in gathering, receiving or processing of information for communication to the public.

(c) As used in this section, “unpublished information” includes information not disseminated to the public by the person from whom disclosure is sought, whether or not related information has been disseminated and includes, but is not limited to, all notes, outtakes, photographs, tapes or other data of whatever sort not itself disseminated to the public through a medium of communication, whether or not published information based upon or related to such material has been disseminated.

On January 18, 2021, Stonedef Records, Inc., announces that The JPF Music Awards (Just Plain Folks) were announced on December 28, 2020 and that Billboard hit singer/songwriter Fawn® won Best Dance Album, Best Dance Song and placed in the runner-up and finalist positions in three other song and album categories.

Due to COVID – 19, the JPF Music Awards were announced on December 28, 2020 online on the JPF Music YouTube channel at 8pm EST. Winners, runner-ups and the top four album finalists and top six song finalists in each category were disclosed within a two hour and eighteen minute program by JPF Music Organization founder Brian Austin Whitney.

There were 4,203 judges from around the world listening to 71,700 album entries and over 230,000 song entries, with a multi-genre mix of music categories, 63 song categories and 75 album categories.  Fawn® won Best Dance Album, “Idiosyncratic” and Best Dance Single, “Small” and won runner-up for Best Holiday Song, “Christmas Time”, the finalist positions for Best Alternative Song, “Over” and Best Holiday Album, “Angels We Have Heard On High.”

Fawn® said: “As a songwriter and independent artist, having this type of recognition is such a blessing. When I learned about the odds of winning or placing in the top five categories, I was blown away. These honors I’ve been given, are from real world listeners and that means a lot to me. I am indebted to Marty Panzer and Pat Pattison for their lyrical mentorship and John Bettis for his encouraging support over the years. I am so grateful an organization Like JPF Music exists. They are a light at the end of a very long, dark tunnel.”

At the online JPF Music Awards, Whitney said: “If you’re a nominee and you don’t show up in the finals tonight, don’t feel bad. It was harder to get a nomination in our awards by the sheer number of entries than it is to get a nomination in the Grammys, so it’s a big achievement.”

If you happen to be in the top six or the top four, I hope that you’ll celebrate! For the first time ever, we have an Honorable Mention category for songs or albums that just missed getting into the top finishers by a single vote or less. 2020 has been rough on everybody and I think this was a great way to have a really positive and upbeat ending to the year. We want to bring as much positive attention as we can to these talents.”

  • Sidebars. Any story 1,000 words or more should have at least one sidebar. Sometimes it’s an info box referring readers to more information from a local organization. Sometimes it’s a list of tips related to the story’s subject. Readers like having information broken up for them and they enjoy multiple points of entry into a story, so we value freelancers who are mindful of that.

We want you to tell your story in your own words. So we will only edit your article for clarity, punctuation, spelling, and grammar. We also reserve the right to change the title of the piece.

PHOTOS:

A photo release will be required for any photos that are submitted. You (or your photographer, if applicable) will retain all rights to the photos you submit, but Holl & Lane retains the right to use any submitted photos to promote your article and the magazine on social media, the blog, our website, or other materials. Photo credit will always be given to the creator. We will not alter the photos other than to resize them to conform to image size specifications for the magazine, social media, and other materials.

SUBMISSION:

  • The Assignment Desk Editor is who selects, develops and plans reporting assignments, either news events or feature stories, to be covered by contributors/reporters. He/She will provide instructions for your article/story will be provided when you are notified of your pitch/assignment selection. Escobar (born in El Salvador, Central America on September 6th and U.S. Naturalized on May 20, 2015) is a multi-award winning American journalist, reporter, editor, columnist, writer, producer, director, publicist, radio personality, entrepreneur, accounts receivable specialist, humanitarian and philanthropist.

Steven Escobar started Diversity News Publications when he saw the word Diversity in an office and it’s meaning, he them decided to call his company Diversity News Publications and started branding the name Diversity News. About Bobbie Shaw Chance:

Bobbie Shaw Chance began her acting career at only 17 years old with the help of acclaimed agent to the stars and former vice president of ICM talent management, Jack Gilardi.

Bobbie Shaw Chance aka Acting Coach to the Stars. ‘E’ Entertainment began her legendary career starring in the “Beach Party Films” as a young ingénue with Franky Avalon. She went on to star with Rob Reiner academy award winning Richard Dreyfus and Larry Bishop. In “The Session” New York and Los Angeles’s first improvisational comedy group that ultimately paved the way for future successful shows of its kind, such as “Saturday Night Live” and “Who’s line is it anyway.”

When “The Session” split up, Bobbie married writer Larry Chance, had 2 children Allison and Richard, starred in five independent feature films and began her crusade with The Abused Children’s Foundation in conjunction with The Free Arts for abused children. She invented a process by incorporating Theater games and on-stage improvisation as a means to treat the children’s emotional wounds. As a result Bobbie has been successful in getting hundreds of children to open up and learn to trust others through the arts.

In 1990, while raising her two children Allison and Richie with her Husband, Larry, Bobbie opened the Hollywood Actor’s Showcase, LLC formerly Expressions Unlimited actors workshop in Sherman Oaks, California. With an ever-changing group of talent coming through the door from new up-and-comers to soon to be famous celebrities including; Giovanni Ribisi, Stephen Dorff, Breckin Myer, Devon Aoki, Scarlett Johansson, Drew Barrymore, Taryn Manning and more, Expressions Unlimited now known as Hollywood Actor’s Showcase became a staple in Hollywood.

Over the years, leading television networks have and continue to cast Bobbie as Hollywood’s acting guru on show’s such as WB’s hit show “The Starlet” with Faye Dunaway and Vivica A. Bobbie Shaw Chance has been contracted by Star Audiovisual Media Group to coach aspiring and professional actors live in the People’s Republic of China with a two city tour to Beijing and Shanghai.

The vision of the trip is to bring ‘Hollywood to China’ through artistic collaboration via the craft of acting. This has been arranged by Donna Zhang, Secretary General for the High Tech Committee in Beijing and Head of the Beijing Film Commission. Bobbie’s tour begins Winter 2015.

Breaking News: Miss Universe Organization Statement on Miss USA and Miss Universe Beauty Pageants

MISS USA AND MISS UNIVERSE THE SHOW MUST GO ON!

As you may have seen earlier today Monday, June 29, 2015 our breaking news story on NBCUniversal dropping Miss USA and Miss Universe beauty pageants from the networks due to the derogatory statements on Immigrants made by it’s co-owner and producer Mr. Donald J. Trump. Also Mexico’s Televisa  and Carlos Slim from Ora TV ends relationship with Miss Universe.

To be fair and heard both sides, we contacted Miss Universe Organization in New York, NY to get a statement and here is what we received, you can see it and read below their statement. You can read that Miss Universe Organization (MUO) is trying to separate from Mr. Donald J. Trump Sr.

The 2015 MISS USA® Pageant will still take place in Baton Rouge on July 12th. We are disheartened by recent events but the show will go on.

The Miss Universe Organization operates as an independent company. In its 64 year history, and under many owners, Miss Universe has developed into a globally recognized brand, with nearly 150 franchise holders domestically and internationally, the majority of whom are small business owners.

The Miss Universe Organization is built on a foundation of inclusion and continues to be a celebration of diversity and of all cultures. This year’s Miss USA contestants represent many different ethnic backgrounds, including six Latinas (four of whom are of Mexican descent).

Annually, nearly ten thousand young women all around the world participate in MISS UNIVERSE pageant events. We continue to welcome those from all backgrounds to enter our system. Our franchisees work tirelessly every day to empower young women to be confident and to be their personal best while raising awareness and millions of dollars for philanthropic endeavors.

While world politics and other influences will undoubtedly play a role, the pageant will always seek to transcend controversy. It is unfortunate that recent events beyond our control have only served to negatively impact the women who participate in the pageant, our state directors, our sponsors and our fans. We want our supporters to know we remain committed to them and we will be conducting the pageant, regardless of the current situation. We are moving forward, full-steam ahead as planned for the next two weeks, culminating in the crowning of a new Miss USA on July 12th .

The weather is warming up, people are starting to spend more time outdoors, and it’s about to be everyone’s favorite time of year. With spring just around the corner, it’s time to start thinking about your spring cleaning. And while cleaning out your oven is essential, it’s not that interesting to read about. So we’re going to take a look at another, often neglected area of spring cleaning, cleaning out your wardrobe.

When was the last time you went through your clothes and decided to get rid of all of those clothes you never wear? Can’t remember? You’re not alone. Many of us just let the clothes pile up over time with the thought that hey, we’ll wear this old shirt again someday, right? Wrong. You need to cut the cord and realize that the clothes you don’t like now, you’re never going to like. Spring cleaning is the time to be judicious, and that means taking a hard look at what should stay and what should go. Need some help getting started? We’ve put together a little checklist to guide you along the way. Check it out:

Start with the Basics
Need a place to start? Go for the socks, tee shirts, and underwear drawer, as these are the items that tend to go unnoticed for the longest time. And trust us, you don’t want to let them go that long. In most cases, you could use a refresher on your socks and underwear. Instead of just getting the same plastic package from the department store, treat yourself to something a little higher quality this time around. Try something like VK Nagrani designer underwear that you’ll actually enjoy wearing. With higher quality materials, more interesting styles, and a more flattering cut, you won’t miss your old undies, we promise.

Move into Outerwear
Once you’ve covered the basics, you should move into your outerwear collection. As the weather is getting warmer and you’re going to be moving your jackets to the back of the closet, it’s the perfect time to start thinking about which items are worth storing, and which are just taking up space. If you live somewhere exceptionally cold, we understand holding onto a few extra layers for the sake of warmth, but for most people, if you have more than four jackets, you’re probably never wearing them. Do yourself a favor and toss the ones that you haven’t taken out in years. They’re just a bulky waste of space, and the people at Goodwill can give them to someone who will appreciate them much more.

Judge Your Footwear
Out of everything in your wardrobe, your shoes tend to age the fastest. With the constant contact with rain, pavement, dirt, and grime, your shoes show their age very quickly and very noticeably. While you might have broken in your favorite pair, they probably don’t have the same luster they did when you bought them. It’s ok to say goodbye to your shoes, they were never made to last forever.

When in Doubt, Toss It
The golden rule of spring wardrobe cleaning, if there is such a thing, is that when you’re not sure if you should hold onto something or not, you shouldn’t. Donating your old clothes and shoes is a therapeutic exercise and helps set the stage for becoming the person you want to be. In the spirit of spring renewal, starting over with a new wardrobe is refreshing. You’ll be relieved of that guilty feeling when you see a shirt you haven’t worn in ages, and you’ll make room for some new things to freshen up your look.

On Friday, January 20, 2012 The Multicultural Motion Picture Association announced their upcoming 19th Annual MMPA Oscar® Week luncheon where Academy Award nominees past and present, including Producers, Directors, Film Editors, Actors, Costume Designers, and past honorees are expected to come out for a star-studded afternoon of camaraderie and praise for young up-and-coming film talent.

This year the event will be held at the Sofitel Hotel Los Angeles located at 8555 Beverly Boulevard in Beverly Hills, CA 90048 on Friday, February 24, 2012 at 12:00pm.

Per event producers as in previous years, the 19th Annual MMPA Oscar Week Luncheon will be among the highlights of the week’s activities leading up to the Oscars and the MMPA’s annual luncheon will again be among the hottest tickets in town, this year made even hotter by the buzz surrounding many Golden Globe winners and potential Academy nominees already slated to attend this star-studded affair.

“After a solid year of burgeoning creative accomplishments on the part of our diverse film community, it continues to be inspiring to see the level of Hollywood talent who continue to express their desire to be a part of this afternoon of philanthropy and giving.” said Jarvee Hutcherson, President of The  Multicultural Motion Picture Association (MMPA).

The prestigious organization of actors, cinematographers, editors, writers, and directors has in the past played host to an array of celebrities and nominees from Salma Hayek, Robert DeNiro, Kate Winslet and Djimon Hounsou to Sandra Bullock, Denzel Washington, and Leonardo DiCaprio among others.

Last year at the 18th Annual MMPA 2011 Oscar Week Luncheon Civic Awards were presented to Kate Linder ( Actress, Philanthropist), Edward Lozzi ( Publicist, Edward Lozzi & Associates), Renee’ Valente (Producer, Valente Productions), Michelle Phillips (Actress, Singer) and A.C. Lyles(Paramount Pictures). Each civic honoree gave a speech after receiving their award, but the one who received an outstanding ovation was A.C. Lyles, producer from Paramount Pictures.

The Annual MMPA Oscar Week Luncheon event benefits The Multicultural Motion Picture Association’s Filmmakers Scholarship Fund.  As a part of the annual afternoon affair, awards are presented annually, to filmmakers selected for their creative achievements, vision and technical talent, and in addition to financial awards toward their tuition, film companies traditionally arrange gifts of technical support for scholarship recipients.

The event is open to the MMPA members and the general public is invited to attend. The organization is selling individual tickets starting at $200 and up and group table tickets from $2500 and up for the lunch and awards show.
